Man gets 45.5 years for drive-by shooting, leading police on pursuit

GREELEY, Colo. (Weld County D.A.) – A Windsor man was sentenced to more than four decades in prison after a drive-by shooting and pursuit in northern Colorado last year.

On Tuesday, Weld County District Court Judge Vincente Vigil sentenced Kyle Bertsch, 40, to 45.5 years in the Colorado Department of Corrections.

A jury convicted Bertsch last month of more than a dozen charges related to the incident.

On March 28, 2024, Windsor Police officers responded to reports of shots fired in the 600 block of Gyrfalcon Court and identified Bertsch as the suspect. Witnesses reported that he was in a pickup truck and had fired multiple rounds at an occupied building, damaging the structure and several nearby vehicles. No injuries were reported.

A short time later, two individuals driving near the Intersand America Corp. building on Weld County Road 23 reported that Bertsch had brandished a firearm at them.

Law enforcement agencies across northern Colorado—including Windsor Police, Severance Police, and the Weld and Larimer County Sheriff’s Offices—coordinated to locate Bertsch, leading to a nearly hour-long pursuit.

Several law enforcement vehicles were damaged before Bertsch’s truck became disabled in a field in northern Weld County, where he surrendered.

In October, a jury convicted Bertsch of multiple offenses, including menacing, illegal discharge of a firearm, drug possession, disorderly conduct, criminal mischief, reckless endangerment, eluding, possession of a weapon by a previous offender, and violating a protection order.

Deputy District Attorneys Brandon Dasent and Ash McCuaig both prosecuted this case.
