Windsor man convicted of drive-by shooting, leading police on pursuit

GREELEY, Colo. (Weld County D.A.) – A Weld County jury convicted a Windsor man last week of more than a dozen charges related to a drive-by shooting and multi-agency pursuit that occurred in northern Colorado last year.

On March 28, 2024, Windsor Police officers responded to reports of shots fired in the 600 block of Gyrfalcon Court. Authorities were able to identify the defendant as 40-year-old Kyle Bertsch.

Witnesses reported that Bertsch was in a pickup truck and had fired multiple rounds at an occupied building. Although no one was injured, the gunfire caused damage to the building and several nearby vehicles.

A short time later, two individuals driving near the Intersand America Corp. building on Weld County Road 23 reported that the defendant had brandished a firearm at them.

Law enforcement agencies across northern Colorado—including Windsor Police, Severance Police and the Weld and Larimer County Sheriff’s Offices —worked together to locate and apprehend Bertsch after a nearly hour-long pursuit.

Several law enforcement vehicles were damaged before Bertsch’s truck became disabled in a field in northern Weld County, where he surrendered and was taken into custody.

Following a week-long trial, the jury convicted Bertsch of more than a dozen charges, including: two counts of menacing, illegal discharge of a firearm, unlawful possession of a controlled substance, disorderly conduct, two counts of criminal mischief, two counts of reckless endangerment, eluding, two counts of possession of a weapon by previous offender and violation of a protection order.

Bertsch is scheduled to be sentenced on November 18 at 11:30AM in Division 17.
