Man sentenced to more than 150 years for shooting at officers 33 times

GREELEY, Colo. (Weld County D.A.) – A Weld County man will spend more than 150 years behind bars after he attempted to murder two police officers who were responding to a call at his Eaton home in 2021.
A jury convicted 34-year Levi Miller Tuesday of the following charges: two counts of attempted first-degree murder – after deliberation, two counts of first-degree assault, and four counts of attempted first-degree murder – extreme indifference.
On September 24, 2021, two Eaton officers responded to a report of a domestic dispute at the defendant’s home. When officers arrived at the home, they found Miller, armed with a MK47 rifle with a fully loaded 100 round drum.
Miller fired more than 30 rounds at the officers, prompting them to return fire, which struck Miller.
While shooting at officers, he also struck a neighbor’s house eight times. One bullet pierced their gas line, and the other seven bullets hit the wall of a bedroom where two children were sleeping at the time of the incident.
“These officers were simply doing their job that night by serving and protecting their community,” Chief Deputy District Attorney Michael Pirraglia said. “I don’t care if you call it luck, a blessing or a miracle. The fact that any of these people can walk into the courtroom today is simply amazing.”
The 19th Judicial District Critical Incident Response Team (CIRT) investigated the shooting.
After a thorough investigation, Weld County District Attorney Michael Rourke cleared the officers in November of 2021, and determined they were legally justified in discharging their firearms at Miller during the incident.
Weld County Judge Audrey Galloway sentenced the defendant Wednesday afternoon to 156 years in the Colorado Department of Corrections.
“Their entire job is to help people, to protect people and to keep our communities safe.” Judge Galloway told the defendant during the sentencing hearing. “It’s astounding to me that you did not kill someone that day.”
