Man who raped woman, cut power to her home gets 26 years to life

GREELEY, Colo. (Weld County D.A.) – A man who was convicted of raping a woman after cutting the power to her home in 2016, was sentenced Monday to the Colorado Department of Corrections.

In November, a Weld County jury convicted 30-year-old Damaige Plascencia of sex assault, kidnapping, and burglary.

On Monday, Weld County District Court Judge Allison Esser sentenced the defendant to 26 years to life in DOC. Deputy District Attorney Arynn Clark argued for the maximum sentence of 48 years to life.

This was the maximum sentence permitted after a judicial determination that this defendant does not currently qualify for a sentence in the aggravated range.

On December 30, 2016, at about midnight, Evans police officers were called to an apartment on Denver Street where a woman said she had been raped in her home.

The victim said she arrived home a few hours prior, and no one was in her home when she arrived. She then went upstairs and was showering when all of the lights in her apartment went out.

The victim said she got out of the shower and went to her bedroom where the defendant grabbed her from behind and dragged her into another bedroom. He then covered her mouth with his hands and blankets and assaulted her.

In May of 2017, a DNA match came back for Plascencia and he was charged in Weld District Court for this incident.  

Deputy District Attorney Arynn Clark prosecuted this case.
