DA Rourke Clears Fort Lupton Officer Involved in December Shooting

On Friday, February 21, Weld District Attorney Michael Rourke issued a report to Fort Lupton Police Chief John Fryar, in regard to the officer involved shooting of Matthew Cotter on December 2, 2019, in Fort Lupton.

The Critical Incident Response Team (CIRT) conducted the investigation which was provided to the District Attorney’s Office.

Based on the thorough investigation, DA Rourke has determined the officer is justified for firing at Cotter, after the defendant fired at officers who were responding to a disturbance call at a Fort Lupton home.

Cotter will appear in court for a status conference on April 7, at 8:15 a.m. in Division 15.

No further information will be released at this time due to pending litigation in Mr. Cotter’s case.
